Man charged with murder after shooting intruder in shower

Detectives have arrested a homeowner for fatally shooting an intruder he found taking a shower in his Mason County home.

Fanning owns an internet-based business located next to his home, according to the Mason County Sheriff's Office.

A Washington state man found an intruder taking a shower in his house and shot him.

When the homeowner arrived on the second property, he told deputies he found a screen had been taken off the window and the door kicked in.

The homeowner is now charged with second-degree murder.

Fanning phoned 911 after the fatal incident, though offered no explanation as to why he shot the man before he called police, the Olympian reported. CBS affiliate KIRO reports that authorities say the homeowner returned and shot Nathaniel Rosa through shower curtains four times.

Detectives say Fanning went back to his home, got a gun and returned to the other house. "And we've contacted our local prosecutor, explained the circumstances to him, and he agrees that second-degree murder was an appropriate charge in this case".

The sheriff announced the arrest via Twitter and said it would release more information in a press release Monday.

Sheriff's investigators said they didn't find evidence to support necessary or reasonable self-defense, according to the statement.

On Monday, bail was set for Fanning at $250,000. Lt. Adams added "that there was no sign that the homeowner had attempted to call the authorities before shooting the intruder".

State law allows people to use their feelings of being threatened when deciding whether to use lethal force to defend themselves, but the danger must be imminent and threaten life or serious bodily injury.
